1. Acceptance of Terms

Welcome to Chore LLC dba Better Med Spa ("Company," "we," "us," "Better Med Spa & Wellness," or "our"), doing business at bettermedspa.com. These Terms and Conditions ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you," "your," or "client"), and Better Med Spa & Wellness concerning your access to and use of our website, services, facilities, and promotional programs. By accessing our website, scheduling appointments, receiving services at our facility, participating in our promotional programs (including the Refer-a-Friend program), or otherwise engaging with our business, you acknowledge that you have read, understood, and agree to be bound by these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING OUR WEBSITE AND SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right to modify these Terms at any time and for any reason. We will alert you about changes by updating the "Effective Date" of these Terms and posting the revised Terms on our website. Your continued use of our services after any changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to use our services independently. Clients under 18 must be accompanied by a parent or legal guardian who must sign all necessary forms and agreements on their behalf. By using our services, you represent and warrant that:

You are at least 18 years old or have parental/guardian consent.
You have the legal capacity to enter into this agreement.
You have disclosed all relevant medical conditions, allergies, medications, and health information.
You are not pregnant or nursing (for certain services that contraindicate these conditions).
You do not have any medical conditions that would prevent you from safely receiving our services.

3. Services and Medical Disclaimers

Better Med Spa & Wellness provides wellness, aesthetic, and cosmetic services including but not limited to:

Facials and skincare treatments
Body sculpting and contouring
Wellness therapies
Laser treatments
Injectable treatments
Massage therapy
Other aesthetic and wellness services

IMPORTANT MEDICAL DISCLAIMERS:

Not Medical Advice: Our services are for cosmetic and wellness purposes and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Our services do not substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider.

Consult Your Healthcare Provider: Always consult with your physician or healthcare provider before beginning any treatment, especially if you have medical conditions, are pregnant or nursing, or are taking medications.

No Guarantees: We make no guarantees regarding treatment outcomes. Individual results may vary based on numerous factors including but not limited to age, skin type, lifestyle, medical history, and adherence to aftercare instructions.

Possible Risks: All treatments carry potential risks including but not limited to redness, swelling, bruising, discomfort, allergic reactions, scarring, infection, or other adverse effects. You acknowledge these risks and accept full responsibility for your decision to proceed with treatments.

4. Payment Terms

Payment is due at the time services are rendered unless other arrangements have been made in advance. We accept cash, credit cards, and, debit cards.

Service Credits and Gift Cards: Service credits and gift cards are non-refundable and non-transferable. They cannot be redeemed for cash and must be used within one (1) year of issuance unless otherwise specified.

Retail Products: All retail product sales are final. Products cannot be returned or exchanged unless defective.

Package Deals: Pre-paid packages must be used within one (1) year of purchase. Unused services in packages are forfeited after the expiration period with no refund.

5. Cancellation, Rescheduling, and No-Show Policy

We understand that plans can change. To ensure fairness to all clients and staff, the following policies apply:

24-Hour Notice Required: You must provide at least 24 hours advance notice to cancel or reschedule any appointment.

Late Cancellation Fee: Cancellations made within 24 hours of your scheduled appointment will be charged 50% of the originally booked service fee.

No-Show Policy: Failure to attend your appointment without prior notice will result in a charge of 100% of the booked service fee.

Late Arrival Policy: If you arrive late for your appointment, your service time may need to be shortened to accommodate other clients. You will be responsible for payment of the full service fee regardless of shortened treatment time. Sessions will not be extended due to late arrivals.

How to Cancel or Reschedule: Contact us by phone or email at hello@bettermedspa.com to cancel or reschedule appointments. If you cannot reach us by phone, email communication is acceptable to avoid charges, provided it is sent within the required timeframe.

6. Membership Program

Our membership program offers exclusive benefits and discounts with the following terms:

Minimum Commitment: All memberships require a minimum 12-month commitment from the date of enrollment.

Early Termination: If you wish to cancel your membership before completing the 12-month commitment period, you will be charged an early termination fee of $200.

Membership Benefits: Membership benefits, discounts, and services are non-transferable and cannot be shared with other individuals.

Billing: Membership fees are billed monthly and must be kept current to maintain membership benefits.

7. Refer-a-Friend Promotion ("Give $50, Get $50")

Our Refer-a-Friend program allows existing clients to earn rewards for referring new clients, subject to the following terms and restrictions:

Program Structure: Both the referring client and the referred client receive a $50 credit toward future services when the
referred client completes their first qualifying service.

Eligibility Requirements:

Referrer must be an existing client of Better Med Spa & Wellness.

Referred client must be a new client who has not previously received services.

Credits apply only to non-medical, cosmetic wellness services.

Credits cannot be used for services covered by insurance or federal healthcare programs.

Credits cannot be applied to retail product purchases.

Legal Compliance and Restrictions:

This program excludes any services that may be reimbursed by Medicare, Medicaid, or other federal healthcare programs.

The program is not available in jurisdictions where referral incentives for healthcare services are prohibited by law.

No referral incentives are provided for federally reimbursed healthcare services in compliance with federal anti-kickback statutes.

All program details are transparently disclosed; no misleading claims are made regarding benefits

Credit Terms:

Credits are issued as account credits, not cash.

Credits cannot be exchanged for cash value.

Credits are non-transferable and cannot be combined with other offers unless specifically stated.

Each client is limited to one referral credit per new client referred.

Credits cannot be applied to prior purchases.

Credits expire one (1) year from date of issuance if unused.

Privacy Protection:

In compliance with HIPAA, no protected health information will be shared in connection with referrals without proper written consent.

8. Privacy and Confidentiality

We are committed to protecting your privacy and complying with all applicable privacy laws, including HIPAA where applicable. Our collection, use, and disclosure of personal information is governed by our separate Privacy Policy, which is incorporated into these Terms by reference.

Protected Health Information: Any health information you provide is considered confidential and will be protected in accordance with applicable privacy laws. We will not share your health information without your written consent except as required or permitted by law.

Marketing Communications: By providing your contact information, you consent to receive appointment confirmations, service reminders, and promotional communications. You may opt out of marketing communications at any time.

9. Electronic Signature and Communications Consent

Electronic Signature Disclosure: By using our website and services, you consent to conduct business electronically and to receive documents, agreements, and communications in electronic format. Electronic signatures and records have the same legal effect as traditional paper documents.

Withdraw your consent to electronic communications at any time.

Access and retain electronic records for your files

Technical Requirements:

To access electronic documents, you need a device with internet access and a current web browser. We will notify you of any changes to these technical requirements.

10. Limitation of Liability and Disclaimers

Services Provided "As Is": Our services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

No Warranties: We expressly disclaim all warranties including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

Limitation of Liability: To the fullest extent permitted by law, Better Med Spa & Wellness and its owners, officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Maximum Liability: Our total liability to you for any claims arising from or related to our services shall not exceed the amount you paid for the specific service giving rise to the claim.

Release and Waiver: You voluntarily assume all risks associated with our services and release Better Med Spa & Wellness from any claims for personal injury, property damage, or other harm that may result from your use of our services, except to the extent such release is prohibited bylaw.

Indemnification: You agree to indemnify, defend, and hold harmless Better Med Spa & Wellness from any claims, damages, or expenses (including reasonable attorney fees) arising from your breach of these Terms, your use of our services, or your violation of any law or third-party rights.

11. Intellectual Property

All content on our website and in our materials, including but not limited to text, graphics, logos, images, and software, is the property of Better Med Spa & Wellness or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without written permission.

12. Prohibited Conduct

You agree not to:

Use our services for any unlawful purpose or in violation of these Terms.

Provide false or misleading information.

Interfere with the operation of our website or services.

Attempt to gain unauthorized access to our systems.

Engage in any conduct that could damage our reputation or business.

Violate the rights of other clients or staff members.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved in the state or federal courts located in Cook County, Illinois.

Mediation Requirement: Before filing any lawsuit, the parties agree to attempt to resolve disputes through mediation with a mutually agreed-upon mediator.

Class Action Waiver: You waive any right to participate in class action lawsuits against Better Med Spa & Wellness.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely approximates the intent of the original provision.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Better Med Spa & Wellness regarding your use of our services and supersede all prior or contemporaneous agreements.
